By creating a Merchant Account through the FastSTAART website, the user agrees to defend, indemnify, and hold harmless the Greater Stockton Chamber of Commerce, its Board of Directors, and its members, officers, employees, and agents from and against any and all damages, costs (including reasonable attorneys' fees), judgments, and other expenses arising out of or in connection with any third-party claims. These claims may result from or relate to the user’s use of the STAART App, the Website, and/or the Merchant Account, or any breach of the terms of this Agreement by the user, whether due to intentional misconduct or negligence by the user. This clause ensures that the user is responsible for defending and covering the costs of any legal claims arising from their use of the STAART App, the Website, and/or the Merchant Account and any violation of the terms, protecting the Chamber and its affiliates from liability.
